A GUIDE FOR MASJID AND COMMUNITY MEMBERS ON DEALING WITH ICE

Assalamu Alaykum,

 

We wanted to provide important information and guidance on how to handle interactions with ICE (Immigration and Customs Enforcement) to ensure the safety and rights of our community.

 

What Is ICE?
ICE (Immigration and Customs Enforcement) is part of the U.S. Department of Homeland Security. It enforces immigration laws, conducts arrests, raids, detentions, and deportations, often collaborating with local law enforcement. These actions frequently create fear within targeted immigrant communities.

 

Who is at Risk for Targeting by ICE?

  • Noncitizens without immigration status.
  • Noncitizens who have violated the terms of their immigration status.
  • ICE prioritizes individuals who:
    • Have certain types of criminal convictions,
    • Have prior orders of deportation
    • Are considered a threat to national security.

Your Rights During ICE Interactions:

  • Remain Silent: You are not required to answer questions about your immigration status.
  • Speak to a Lawyer: Avoid signing anything without legal advice.
  • Request a Phone Call: Foreign nationals have the right to contact their consulate.

What Should We Do If ICE Shows Up at Our Masjid?

  • ICE cannot enter a private space like a masjid without a judicial warrant or consent.
  • If ICE arrives:
    • Do not allow entry and ask for a judicial warrant.
    • Refuse to answer questions.
    • Clearly post signs stating the masjid is private property to prevent claims of public access.
    • Designate individuals authorized to handle ICE interactions.

What Should I Watch for if ICE Shows Up?

  • ICE may use tricks, lies, or intimidation to gain entry.
  • ICE almost never has a judicial warrant.
  • Internal DHS documents titled "Warrant" are NOT valid judicial warrants. A valid judicial warrant must:
    • Be signed by a judge.
    • Be issued by a courthouse.

Steps If ICE Has a Valid Judicial Warrant

  1. Ask for identification from ICE agents.
  2. Review the warrant to determine the search and seizure scope.
  3. Accompany ICE agents at all times to monitor compliance.
  4. Document and record all interactions with ICE agents.

Important Update: Rescission of the Sensitive Locations Policy

 

On January 20, 2025, the Trump Administration rescinded the policy that protected places of worship, schools, and hospitals from enforcement actions. While this change creates fear in immigrant communities, ICE still needs a judicial warrant or consent to enter private spaces. Never provide consent voluntarily.
